These Terms of Service ("Terms") govern your access to and use of the netprotrxum analytics platform, website, and related services (collectively, the "Services") provided by netprotrxum AS, a Norwegian company with registration number 362514798 ("netprotrxum", "we", "us", or "our").

Our Services are designed to help retail businesses analyse customer behaviour, create targeted marketing campaigns, and improve customer engagement through data-driven insights.
User Accounts and Registration
To access certain features of our Services, you may be required to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use of your account
- Accept responsibility for all activities that occur under your account
You may not create an account using false information or impersonate another person or entity. We reserve the right to suspend or terminate accounts that violate these Terms.

Payment Terms
If you purchase a paid subscription to our Services, you agree to pay all applicable fees as described on our website or in your subscription agreement. Payment terms include:
- Fees are charged in advance on a monthly or annual basis
- All fees are non-refundable unless otherwise specified
- We may change our fees upon thirty (30) days' notice
- Failure to pay fees may result in suspension or termination of Services
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NETPROTRXUM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO NETPROTRXUM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. NETPROTRXUM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
- WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANALYTICAL RESULTS
- WARRANTIES THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS
Indemnification
You agree to indemnify, defend, and hold harmless netprotrxum and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of and access to the Services
- Your violation of these Terms
- Your violation of any third-party rights, including privacy rights
- Any content or data you provide through the Services
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Bergen, Norway, and you hereby consent to personal jurisdiction and venue therein.
If you are a consumer residing in the European Union, you may have additional rights under local consumer protection laws, and nothing in these Terms shall limit such rights.
Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Services will cease immediately.
Effect of Termination
Upon termination:
- Your access to the Services will be immediately revoked
- We may delete your account and associated data
- You remain liable for any outstanding fees or obligations
- Provisions that by their nature should survive termination shall remain in effect
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and netprotrxum concerning the Services and supersede all prior or contemporaneous communications and proposals.
